Please read the Conditions carefully before using this website. By using this website or placing an order on it, you agree to be bound by these Conditions, if you do not agree with all the Conditions, you should not use this website.
These Conditions could be modified. It is your responsibility to read them periodically since the conditions in force at the time of use of the website will be those that will be applicable to you.
1. SCOPE OF THE CONTRACT
These General Purchase Conditions apply to the sale of all Brott products through its website, to consumers to whom orders can be delivered anywhere in the world.
Brott informs that his website is aimed at people over 18 years of age. If you are a minor, we recommend that you consult this information with your parents or guardians.
2. YOUR DATA AND YOUR VISITS TO BROTTDOG.COM

4. AVAILABILITY OF PRODUCTS

5. CANCELLATION OF AN ORDER
We reserve the right to withdraw any product from this website at any time and to remove or modify any material or content on this website. We will always try to process all orders but there may be circumstances that force us to cancel an order after having sent the order confirmation, so we reserve the right to do so at any time without being responsible to you or any third party.
6. DELIVERY
The delivery will be made to the address you indicate, which may be different from your habitual residence, and may be sent to your place of work or even to a third person to whom you wish to give a gift. In any of the cases, the identification of the buyer or of the person to whom the product is addressed will be required by means of an official document that identifies him and signature of the delivery note.
The delivery period set on the website will be merely indicative. However, Brott will endeavor to respect this term, not being responsible in case of exceeding the initially estimated term.
7. NON-DELIVERY
If after two attempts we find it impossible to deliver your order, the transport company will store the product for 15 days so that you can pick it up. In addition, we will leave you a note explaining where your order is and how to collect it. If you are not going to be at the place of delivery at the specified time, please contact us or the transport company to arrange delivery on another day.
After 15 days, if the order has not been delivered for reasons not attributable to us, we will be authorized to recover the products, without the possibility of claiming for them.
8. PRICE AND PAYMENT
The price of the products will be the one stipulated at any time on this web page, except in case of error. In the event of an error, we will inform you as soon as possible, giving you the option to confirm your order at the correct price or cancel it. If we are unable to contact you, we reserve the right to refund the amount of the order and cancel it.
The prices on this website are expressed in EUROS and include VAT, but exclude shipping costs, which will be added to the total amount due as stated in the Shipping section. The delivery of the order may be subject to customs taxes.
You can make the payment with Visa, MasterCard and through PayPal. To minimize the risk, your credit card details will be encrypted. The charge on your card will be made at the time you confirm your order.

9. EXCHANGES/RETURNS
Right of withdrawal for consumers
Consumers have a statutory period of 14 calendar days from receipt of the order to exercise their right of withdrawal, without having to provide any reason. Brott voluntarily extends this period and accepts returns for up to 30 calendar days from receipt of the order, provided that the conditions for returns set out herein are met.
To request a return, the customer must notify Brott in writing at guau@brottdog.com, stating the order number and the products they wish to return.
Customers may request the model withdrawal form in writing at guau@brottdog.com. Use of this form is not mandatory and customers may exercise their right of withdrawal by means of any unequivocal statement expressing their decision to withdraw from the purchase.
Except in the case of a defective or incorrect product or lack of conformity, the direct costs of returning the products shall be borne by the customer.
Brott will refund all amounts legally due using the same means of payment used for the original transaction, in accordance with the time limits established by applicable legislation.
The right of withdrawal shall not apply to products made to the customer's particular specifications or clearly personalised, such as special measurements, personalisations or other modifications expressly requested by the customer.
Products from Brott's standard catalogue that are made to order in standard sizes, colours and options shall not be considered personalised or made-to-measure products.
Consequences of withdrawal
In the event of withdrawal, Brott will refund all payments received, including the delivery costs corresponding to the least expensive standard delivery method offered, without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of the decision to withdraw.
The refund will be made using the same means of payment used for the original transaction, unless the customer has expressly agreed otherwise, provided that this does not result in any additional costs.
Brott may withhold the refund until the returned products have been received or until the customer provides evidence that the products have been returned, whichever occurs first.

The products must be returned without undue delay and, in any event, no later than 14 calendar days from the date on which the decision to withdraw is communicated. The deadline shall be deemed to have been met if the customer sends the products before the 14-day period has expired.
The direct costs of returning the products shall be borne by the customer, except in the case of a defective or incorrect product or a lack of conformity attributable to Brott.
The customer shall only be liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
Exceptions to the right of withdrawal
The right of withdrawal shall not apply to products made according to particular specifications requested by the customer or clearly personalised, such as special measurements outside our standard sizing, personalisations or other modifications expressly requested by the customer.
Products belonging to Brott's standard catalogue that are made to order in standard sizes, colours and options shall not be considered personalised or made-to-measure products and shall remain subject to the right of withdrawal.
This exception to the right of withdrawal does not limit the customer's rights where a personalised or made-to-measure product is defective, incorrect or does not conform to the contract.
International returns
The direct costs associated with international returns shall be borne by the customer. Brott shall not be responsible for any customs duties, taxes or customs clearance charges arising from the return shipment.
Where applicable, we recommend clearly identifying the shipment to the carrier as returned goods to prevent it from being treated as a new import.
10. LIABILITY
At Brott we do our best to ensure that product descriptions and specifications are accurate and correct to as much detail as possible. The colors that appear on the website are a faithful representation of the original, however, they may vary slightly from the colors of the actual product due to the resolution of your screen or browser.
We are not responsible for damages that may be caused by an act of God or force majeure, strikes, wars, technical breakdowns, maintenance operations, interruptions or operating errors, impossibility of access, lack of availability and/or continuity of the portal. , data loss, delays in the delivery/collection of orders and in general, for any event that makes it impossible for us to properly comply with and operate our services. 14. WARRANTY
All products sold by Brott are covered by the three-year statutory guarantee of conformity from the date of delivery, in accordance with applicable consumer protection legislation.
The guarantee covers any lack of conformity existing at the time of delivery that becomes apparent within the statutory guarantee period. This may include manufacturing defects, such as defects in workmanship or stitching, structural defects in metal components, or material defects that are not the result of normal use.
The guarantee does not cover damage resulting from improper use of the product, accidents, bites, snagging, cuts, tears or other external causes, nor normal wear and tear of materials resulting from use and the passage of time, provided that such damage is not due to a lack of conformity of the product.
In the event of a lack of conformity, the consumer shall be entitled to the remedies provided for by applicable law. Brott may repair or replace the product where appropriate and legally applicable. If the original product is no longer available, Brott may propose a product with equivalent characteristics, without prejudice to any other rights available to the consumer under applicable legislation.
To report a possible lack of conformity, the customer must contact Brott at guau@brottdog.com, providing the order details and, where possible, photographs that will enable us to assess the issue.
If a parcel is received visibly damaged, we recommend noting this on the carrier's delivery receipt and notifying Brott as soon as possible, providing photographs where possible. This will facilitate the handling of any claim with the carrier, without prejudice to the consumer's statutory rights.
15. VALIDITY OF OFFERS
Offers offered on brottdog.com are valid while stocks last. If the stock is out of stock, the amount paid by the customer will be refunded or a product with the same or superior characteristics will be offered.
16. APPLICABLE LAW AND JURISDICTION
The terms and conditions that govern this page and all the relationships that may derive from it are safeguarded by Spanish legislation. Any controversy that arises, is related to or could be derived from the access or use of this page is submitted to the exclusive jurisdiction of the Courts of Barcelona.
